LEGAL BASES FOR PARTICIPATION IN THE PROMOTION

1.- COMPANY ORGANIZING THE PROMOTION

The Company TEXTILES MARTINEZ CURIEL SL with registered office at AVD. NORTE DE CASTILLA Nº7 CP 47008 VALLADOLID and identification number CIF B47684618 organizes for promotional purposes the raffle (hereinafter, "the Promotion ") of national scope, to be developed through the Internet, exclusively for users residing in Spain and of legal age in accordance with the provisions set forth in the section on conditions for participation.

 

2.-START DATE AND END DATE

The Promotion will start on 10/08/2021 and end on 11/05/2021.

The Company reserves the right to not proceed with the promotional campaign if, by the start date shown, no more than 100 participants have participated. Likewise, the Company may extend the promotional campaign for two more weeks, with the new end date being November 22, 2021.

 

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

It is important to emphasize that participation in the Contest implies unconditional acceptance and compliance with the provisions of these Legal Bases.

The participation requirements will be as follows:

  • Those who reside in Spain and are over 18 years of age are eligible to participate.
  • Participants must leave their email address and accept the terms and conditions.
  • The personal data with which participants fill out the registration form must be truthful.
  • Participants may only register once for this promotion.

The Promotion consists of providing your email address in our specific sweepstakes forms and waiting for the contest to be resolved.

 

4.- CONDITIONS OF THE PROMOTION AND PRIZES

One winner and three random alternates will be drawn on November 8th.

The winner will receive a €300 gift card/coupon as a prize, redeemable for products from https://soleramoda.com/.

The winner may contact the Company within five days of the announcement on the brand's social media profile https://www.instagram.com/solera_moda/ . If no such contact is made within the stipulated period, an alternate winner will be selected.

The drawing and the awarding of the prize are subject to current tax regulations.

 

5.- LIMITATIONS

If it is found that any of the participants do not meet the requirements set forth in the Rules, or the information provided to participate is invalid, their participation will be deemed void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

The following persons may not participate in the Promotion: (i) Employees employed in any of the companies and other entities with legal personality linked to TEXTILES MARTINEZ CURIEL SL (ii) Natural persons who participate directly or indirectly in the capital of TEXTILES MARTINEZ CURIEL SL (iii) Any other natural person who has participated directly or indirectly in the organization of this Contest or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).

The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the Participants, and cannot be exchanged for any other product or cash.

TEXTILES MARTINEZ CURIEL SL reserves the right, if there is just cause and after prior legal notification, to make any changes, suspend or extend this Promotion.

Any tax or fiscal burden that acceptance of the prize may entail, as well as any other expenses derived from the promotion that are not expressly assumed by TEXTILES MARTINEZ CURIEL SL in these Legal Bases, will be borne by the winner.

A period of FIFTEEN (15) calendar days is established from the date of the award of the prize, to make any justified claim. TEXTILES MARTINEZ CURIEL SL reserves, in case of necessary need, the right to replace the prize with another of similar characteristics.

 

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, libelous, or discriminatory, or that could violate the rights of third parties, will not be permitted. Comments against individuals that violate the principles of the right to honor, personal and family privacy, and one's own image will not be permitted. We will not be liable for any damages caused by comments made by participants in the Promotion that may at any time offend the sensibilities of other participants.

Any attempt to hinder the smooth running of the Contest, whether through human intervention or an automaton, will result in the immediate disqualification of the participant and the annulment of his or her application.

 

7.- EXEMPTION FROM LIABILITY

By way of example, but not limited to, we are not responsible for any possible losses, thefts, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion, and we do not assume any responsibility for any damage or harm of any kind that the Participants, winner or third parties may suffer.

We assume no liability in cases of force majeure or unforeseeable circumstances that may prevent the Promotion or the full or partial enjoyment of the prize. Should this Promotion not be held due to fraud detected during the promotion, technical errors, or any other reason beyond the control of TEXTILES MARTINEZ CURIEL SL and which affects the normal conduct of the Contest, we reserve the right to cancel, modify, or suspend the Promotion, including the participation website.

 

9.- CHANGES

We reserve the right to modify or expand these promotional rules, provided that this does not harm or impair the rights of participants in the Promotion.

 

10.- APPLICABLE LEGISLATION AND JURISDICTION

These legal terms and conditions shall be governed by Spanish law. The Courts and Tribunals of the Participant's city shall have jurisdiction to resolve any claim or dispute that may arise regarding the validity, interpretation, or enforcement of these terms and conditions.
